Terms of service

These terms govern your use of Home Handoff, Yacht Passport, and Marine OS, provided by Werner Harmonic Labs LLC of Woodland Hills, California. By using any of them you accept these terms. If you are agreeing on behalf of a company, you confirm you are able to bind it.
What the service is
We give a registered address, or a registered vessel, a private record: a place to keep what is installed, what has been done to it, who did the work, and the documents that prove it. Marine OS additionally lets a service company schedule visits, work through inspection checklists, and publish the results to the vessel's owner.
What the service is not
We do not inspect anything. We do not verify what you or anyone else puts into a record. We do not certify condition, guarantee that equipment works, or provide emergency assistance. A record may be incomplete, out of date, or wrong, because it is built from what people put into it.
A Yacht Passport is a private operating record. It is not a statutory or class document, and it does not replace Flag State registration, Class certification, or the requirements of the USCG or any other authority. Nothing here substitutes for a licensed contractor, surveyor, inspector, attorney, or insurance professional.
Astra
Astra answers from the record in front of it and is instructed to say when something is not there. It can still be wrong. Do not rely on it for anything safety-critical, and check anything that matters against the manufacturer's documentation or a qualified trade. To produce an answer, parts of the record are sent to a third-party AI provider, as set out in the privacy policy.
Your responsibilities
Keep your account details accurate and your credentials to yourself. Upload only what you have the right to upload. Do not use the service for anything unlawful, and do not attempt to reach a record you have not been given access to.
If you connect a Home Assistant instance, you are responsible for the token you provide and for what that token can do in your own home. Issue one with the narrowest access that will work, and remove the connection when you no longer want it.
Ownership
What you put into a record stays yours. You grant us only the permission needed to store, process, and display it so the service can work, including sending the parts described in the privacy policy to our processors. We own the software itself and everything we have built into it.
Transferring a Home Passport moves control of the record. It does not determine legal title to real property.
In Marine OS, the record of a vessel belongs to the owner of that vessel. A service company controls when its work is published, but publishing does not give the company ownership of the record, and it does not remove the owner's access to what has already been published.
Availability
We do not currently offer a guaranteed level of service. The product is early and parts of it are unfinished, most notably, Marine OS holds work on the device if a connection drops mid-visit, but it does not yet let you work an entire visit with no connection at all. We would rather say so here than have you discover it at the wrong moment.
Fees
Online checkout is currently disabled. Where a price appears on the site it is indicative; any engagement is arranged directly and confirmed in writing before anything is payable. Fees, scope, delivery, revisions, and refunds are set out in that written agreement, and it takes precedence over anything on the marketing pages.
Ending it
You may stop using the service at any time and ask us to delete your data. We may suspend an account that is being used unlawfully, is attempting to reach records it should not, or is placing the service at risk. Where we can, we will tell you first.
Warranties and liability
To the fullest extent the law allows, the service is provided as it stands and as available, without warranties of any kind. We do not warrant that a record is complete, that a reminder will prevent damage, or that an answer from Astra is free of error.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, for lost profit, or for loss caused by reliance on an incomplete record or on an answer from Astra. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts of Los Angeles County, California have exclusive jurisdiction.
Changes
We may update these terms. If a change materially affects you we will update the date above and, where we hold your address, tell you directly. Continuing to use the service after a change means you accept it.
